Booking Terms & Conditions

1) GENERAL TERMS

1.1 These terms and conditions govern all services provided by Rubix Media Group LTD (the "Supplier"). By commissioning us for any work, the client agrees to these terms.

1.2 The Supplier retains copyright of all recorded materials unless otherwise agreed in writing.

1.3 We reserve the right to use completed work for marketing and promotional purposes, unless the client explicitly requests otherwise in writing before the project begins.

1.4 Any adjustments to these terms must be agreed upon in writing by both parties.

2) PAYMENT TERMS

2.1 Deposits: A non-refundable deposit may be required to secure a booking. The amount will be outlined in the pricing proposal.

2.2 Final Payment: The remaining balance must be paid before final delivery of the project unless otherwise agreed.

2.3 Late Payments: If payment is not received within 14 days of the invoice due date, we reserve the right to charge late fees of 5% per month on the outstanding balance.

2.4 Usage Rights: The client does not obtain usage rights to the final product until full payment has been received.

3) CANCELLATION & POSTPONEMENT

3.1 Whole Project: If a client cancels a project after agreeing to our pricing proposal and entering a contract, they will be subject to a cancellation fee due to loss of work. This includes 100% of all work completed and a percentage of remaining scheduled work, as outlined below.

3.2 Filming:

  • Cancelling after agreeing to the pricing proposal may result in a cancellation fee of up to 50% of the total project cost.

  • If cancellation occurs within 5 working days of the scheduled shoot, we will charge up to 50%.

  • If cancellation occurs on the day of the shoot or after we are on location, we will charge 100% of the shoot day fee.

  • If we need to cancel a booked external crew member, an additional cancellation charge may apply.

  • Any incurred costs & expenses due to cancellation will be chargeable to the client.

3.3 Illness or Unforeseen Circumstances (Supplier Cancellation):

  • If Rubix Media Group LTD is unable to attend a scheduled shoot due to illness, injury, or unforeseen circumstances, we will attempt to provide an alternative solution, such as rescheduling or arranging a replacement videographer/photographer where possible.

  • If a replacement cannot be arranged, and the shoot cannot be rescheduled, we will provide a full refund for any payments made for the missed shoot day.

  • We are not responsible for any indirect losses incurred by the client due to our inability to attend.

3.4 Editing: If the client cancels or postpones a project after editing has begun, they will be required to pay for all completed work, plus any reserved edit time.

3.5 Broadcast & Subcontracted Work: If the client cancels a confirmed project, they will be charged for all completed work, subcontractor fees, and loss of reserved workdays.

3.6 Weather Delays:

  • If poor weather prevents filming, we will reschedule where possible.

  • If we decide filming cannot proceed due to poor weather, we reserve the right to postpone.

  • If the client cancels due to weather but we are in place and able to work, the client is still liable for the agreed fee.

3.7 In the case of force majeure (e.g., natural disasters, war, terrorism), we are not liable for breaches of contract.

3.8 Our shoot and edit time is non-refundable.

3.9 If a project is postponed, cancellation fees still apply unless otherwise agreed.

4) REVISIONS & EDITING

4.1 All projects include one round of minor revisions unless otherwise agreed.

4.2 Additional revisions beyond those included in the pricing proposal may be charged at our hourly rate.

4.3 Editing requests must be submitted in writing within 14 days of receiving the initial edit.

4.4 If no revision requests are made within this timeframe, the project will be considered approved and final.

5) TRAVEL & EXPENSES

5.1 Unless agreed otherwise, travel costs are calculated at £0.45 per mile from our base in Northampton.

5.2 Additional costs, such as accommodation, flights, parking, and subsistence, will be agreed upon in advance and charged accordingly.

6) INTELLECTUAL PROPERTY & USAGE RIGHTS

6.1 Copyright & Licensing:

  • The Supplier retains full copyright of all footage, photography, and creative assets unless otherwise agreed in writing.

  • The client is licensed to use the final delivered content for the agreed purpose.

6.2 Raw Footage:

  • Raw footage remains the property of Rubix Media Group LTD and is not included in the standard package.

  • If a client requires access to raw footage, an additional licensing fee may apply.

7) LIABILITY & INDEMNITY

7.1 The Supplier is not liable for indirect losses, including loss of revenue, business opportunities, or reputation.

7.2 The client agrees to indemnify Rubix Media Group LTD against any legal claims arising from the use of the content.

8) DELIVERY & STORAGE

8.1 The final project will be delivered digitally via a download link unless otherwise specified.

8.2 We do not guarantee long-term storage of files beyond 60 days after project completion.

8.3 After this period, retrieval of archived files may incur an additional fee.

9) CONFIDENTIALITY & DATA PROTECTION

9.1 Both parties agree to keep any confidential information obtained during the project private and not disclose it to third parties.

9.2 The Supplier complies with UK GDPR regulations regarding the handling of client data.

10) AGREEMENT

By commissioning Rubix Media Group LTD, the client agrees to these terms.
